These Terms govern your use of mymilestone.com.au and any purchase you make from My Milestone Australia (ABN 67247796848]) ("we", "us", "our"). By using our site or placing an order, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or use the site under the supervision of a parent or guardian, to place an order.
2. Our products
Our products are custom, made-to-order items printed on demand using your supplied route data, text and selected options. Colours and finishes shown on screen are representations and may vary slightly from the final printed product.
3. Orders and acceptance
Placing an order is an offer to buy. We may accept or decline any order, and may cancel an order (with a full refund) if there's an error in pricing or product information, the item is unavailable, or we suspect fraud or misuse.
4. Pricing and payment
All prices are in Australian Dollars (AUD) and include GST where applicable, unless stated otherwise. Shipping and any taxes or duties are shown at checkout or are the recipient's responsibility as set out in our Shipping Policy. Payments are processed securely by our third-party payment providers.
5. Your content and the right to use it
When you upload a route image, GPS data, text or other material ("Your Content"), you confirm that:
- you own it or have the right to use it; and
- it doesn't infringe anyone's rights or any law, and isn't offensive, misleading or unlawful.
You grant us a non-exclusive licence to use, reproduce and adapt Your Content solely to produce, fulfil and support your order. You remain the owner of Your Content. We may decline to print content we reasonably consider infringing, unlawful or inappropriate.
6. Our intellectual property
The site, our branding, designs, templates and software (excluding Your Content) are owned by us or our licensors and may not be copied or used without permission.
7. Acceptable use
You agree not to misuse the site, interfere with its operation, attempt to access it unlawfully, or use it to create infringing, unlawful or harmful content.
8. Third-party services
We rely on third parties to operate, including our e-commerce platform, print and fulfilment partner, image hosting and payment providers. Your use of the site and orders are also subject to their terms where applicable.
9. Consumer guarantees and liability
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under that law. To the extent permitted by law, and subject to those rights, our liability for any claim is limited to (at our option) replacing the goods or refunding the price paid, and we are not liable for indirect or consequential loss.
10. Changes
We may update these Terms from time to time. The version in effect when you order applies to that order. Continued use of the site means you accept the current Terms.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.
